Overview

Welcome to Candleicious. In these Terms of Service (the "Terms"), the words "we", "us", and "our" refer to Candleicious, and "you" refers to the person visiting our website, creating an account, or purchasing our handcrafted candles, wax melts, and related products (the "Services"). By accessing or using the Services you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility & Account

By using the Services you confirm that you are at least the age of majority in your province or state of residence, or that you are using the Services under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

If you create an account, you are responsible for keeping your login credentials secure and for any activity that occurs under your account. Please provide accurate, current and complete information at checkout so we can fulfill your order.

2. Our Products

We work hard to represent the color, scent story, and appearance of each product accurately, but slight variations are natural for a small-batch, hand-poured product. Colors may also appear differently depending on your screen. We do not warrant that a product will exactly match what is shown online.

Product descriptions, availability, and pricing are subject to change at any time. We may limit quantities or discontinue a product at our discretion.

3. Orders & Acceptance

When you place an order you are making an offer to purchase. Your order is only accepted once we send an order confirmation and successfully process payment. We reserve the right to refuse, cancel, or limit any order at our discretion, including for suspected fraud, pricing errors, or inventory shortages.

Returns and exchanges are handled under our separate Refund Policy.

4. Pricing & Payment

All prices are shown in Canadian dollars (CAD) unless stated otherwise and do not include taxes, shipping, or applicable duties. The price charged is the price displayed at the time your order is submitted.

You represent that the payment information you provide is accurate and that you are authorized to use the payment method chosen at checkout.

5. Shipping & Delivery

Estimated ship dates and delivery windows are provided as a courtesy only. We are not responsible for delays caused by carriers, customs, weather, or other events outside our control. Once a package is handed off to the carrier, title and risk of loss transfer to you.

6. Candle Safety

Candles are open-flame products. Always trim the wick to ¼ inch before lighting, burn on a heat-safe surface, keep away from drafts, children, pets, and flammable materials, and never leave a burning candle unattended. Do not burn for more than 4 hours at a time. You assume all responsibility for the safe use of our products.

7. Intellectual Property

The Candleicious name, logo, product names, imagery, copy, and the overall look and feel of this website are owned by Candleicious and are protected by copyright, trademark, and other laws. You may browse the Services for personal, non-commercial use only. You may not copy, reproduce, modify, republish, or redistribute any content from the Services without our prior written permission.

8. Third-Party Links & Tools

The Services may link to third-party websites or use third-party tools that we do not control. We are not responsible for the content, policies, or practices of any third party, and your use of any linked site or tool is at your own risk.

9. User Feedback

If you send us reviews, ideas, suggestions, or other feedback, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that feedback in connection with operating and promoting the Services. We are not obligated to keep feedback confidential or to compensate you for it.

10. Prohibited Uses

You agree not to use the Services to:

• violate any applicable law or regulation;
• infringe our intellectual property rights or those of any third party;
• harass, abuse, or harm another person;
• transmit malware, spam, or misleading information;
• scrape, crawl, or use automated tools to access the Services without our written permission; or
• interfere with the security or normal operation of the Services.

11. Errors & Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, or availability. We reserve the right to correct any errors and to change or update information (including after an order has been submitted) without prior notice.

12. Disclaimer of Warranties

The Services and all products are provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, secure, or error-free, and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

13. Limitation of Liability

To the fullest extent permitted by law, Candleicious and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products. Our total liability for any claim relating to the Services or a product will not exceed the amount you paid for the product giving rise to the claim.

14. Indemnification

You agree to indemnify and hold Candleicious harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms. Sections that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute arising from these Terms or the Services.

17. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date. Your continued use of the Services after any changes take effect constitutes acceptance of the revised Terms.
